Comprehensive immigration reform is too dangerous for
Congress to touch.

So the executive over-reaches and the judiciary is
over-activist.

It's much safer for senators and representatives

illegal workforce that has to accept, without complaint
or organizing, compensation and conditions that no legal
American would accept.

But ultimately, it's the voters who keep electing these
legislators.      The best way forward is to eliminate

How should ballot measures be titled and summarized?

Not by a partisan elected official, it seems.     But not
by the proponents either, who have proven more than willing
to circulate blatant lies on broadcast and social media.

Libertarian solution to homelessness.

Read carefully, and you'll see it's advocating forcible
removal, perhaps by private security guards, of the
homeless population to scenic, low-rent, sparsely populated
places - perhaps Manzanar, Tule Lake, Heart Mountain come
to mind - where for some reason the homeless do not want
to go.      Very libertarian - for rich people.

Lots of rural areas would like the economic benefit of a
state prison nearby - but a libertarian solution would be
a private prison  because it costs less - has a smaller
payroll - produces less economic benefit to the local area
- and that might not be so popular.

George Will is right that the National Popular Vote compact
is a bad idea, but for the wrong reason.     Its adherents
are insufficiently tuned in to the constitutional crisis
if the national popular vote were decided by a very small
majority - how is a national recount going to work?

Both writers miss the point that the Electoral
College system we have is a state-by-state choice for
winner-take-all that is not mandated by the Constitution
or any Federal law.     Nebraska and Maine don't do it
that way.     That could be changed at the state level
with no constitutional amendment, but the small rural
states won't because it might diminish their influence.

a say, and then everybody can vote for their choice of the
top two Democratic candidates.     But what about people
that don't like either?

"Primary elections identify those who can most

really mythology from the past.    Now, the purpose of
primary elections is to identify who can beat the other
candidates from the SAME party.     Just look at the
Democratic presidential "debates" !  In recent
practice, this means that candidates who best represent the
ideological base of the party tend to defeat candidates
who represent a broader constituency.     Now who has a
state interest in promoting the most divisive candidates
in both parties and suppressing the most moderate ones?

Democratic voters in the general election are different
from Democratic voters in the primary - not to mention
independents.      And we can see that Republican
politicians who know better are afraid to cross Trump for
fear of losing to a Trumpier candidate in the next primary,
even though that Trumpier candidate might well lose the
general election in a swing district.  That's why swing
district politicians, of either party, are so two-faced -
they have to wear one face for the primary and a vastly
different face for the general election.

Sore loser laws are a bigger problem than primaries
themselves.

for reform.  But direct popular vote has its pitfalls too -

crisis if the vote is decided by a very small margin.  The
1960 popular vote difference was only about 50,000 votes -

close 2016 states even though the Greens were willing to
pay for them.       A system in which very close elections
and recounts are small in scope seems a lot more stable.

And you don't even want to know what happens under the
12th Amendment if a third-party or independent candidates
forces the 2020 election into the House of Representatives.

The reason most politicians in swing districts are so

Wendy Hart provided the best-argued comment ever made
on this Facebook page, and though it's not convincing as
an argument against ranked-choice voting, it deserves a

This looks to be similar to range voting.  The math, at
first glance, appears to make sense.  My problem with it
has to do with how I view candidates and representative
government, as well as speech.  I think a candidate
needs to stand for a particular set of principles/ideas.
They advocate for that, and then the people decide if they
like that or not.

Once in office, you need to make decisions based on
those principles and ideals, as you, obviously, can't
do community polling every time something comes along,
and the Founders wouldn't have wanted us to, even if
they'd envisioned it.  They'd seen the problems with
direct democracy from their studies of the Greeks.  So,
all that being said, let's say I am a firm advocate for
traditional math and anti-Common Core (not a far stretch).
If I'm elected, as I was, being the 1st (and only) choice
of those who elected me, then I have a firm mandate to
champion those issues.

(As a side note, during the 2nd Continental Congress,
the NJ--I think--delegates were recalled and replaced,
because the NJ legislature had decided they were in favor
of Independence.  As such, they didn't ask their delegates
who were against independence to represent and advocate
for independence, they got new ones, who were in favor
and could adequately advocate for that position.)

So, if a small group of people voted for me because of
my stance on those issues, but another group voted for
me because I didn't like spending taxpayer dollars on a
astroturf and district parties, and a third group voted for
me because they just didn't like my opponents, how do you
coalesce all of that and adequately champion a certain
set of principles, especially if they are dissimilar
or competing?  It seems to me that it's a finger in
the wind... hmmm... what shall I advocate or vote for
today?  On the flip side, the speech issue is still my
paramount concern.  We already have people trying to
parse words to make themselves sound more appealing to
all people... a political rorschach test, if you will.
Things like ranked-choice voting, and these other methods
will encourage more of that muted, deliberately not trying
to say what I really think.  That then lends itself, as
above, to not having clear principles and clear ideals of
how to act as a representative.  I prefer to have my reps
tell me what they're going to do, and then do it, even
if I disagree with them.  If there are enough people who
disagree along with me, then we replace them with someone
who does agree.  I have yet to be convinced that this idea
(as they mention zealotry) of standing firm in one's
convictions and saying so is a bad thing.  You might
not get elected, but at least you are representing
what you will do once in office.  And that, is a much
higher priority than an ethereal appeal to supposed
"civility" or lack of "zealotry".
I think we need to be able to disagree, and clearly so,
but in a nice way.

RESPONSE:

Do the people who voted for Nader in 2000 think that George
Bush was a preferable or equivalent choice to Al Gore?

Do the people who voted for Stein in 2016 think that
Donald Trump was a preferable or equivalent choice to
Hillary Clinton?

In either case, the third-party votes would have made a
winning difference for the Democrat.

Do the people who voted for one of the other two candidates
think that Jesse Ventura was a preferable or equivalent
choice to the other candidate they didn't vote for?

Do the people who voted for or against Brexit approve
of the choice that will eventually be made, one of many
commanding no majority in Parliament?  What is the voters
had given a choice of a number of alternatives?

If there's really only a binary choice - selected by
partisan primaries or caucuses - what do voters who
don't like either do?  They could vote for a third party
or independent candidate that represents their values -
and risk, in effect, voting for the main party candidate
that LEAST represents their values, as in the cases above.
Or they could NOT vote for that third party or independent
candidate that they would prefer, and vote for their second
choice rather than waste their vote - guaranteeing that
third-party candidates will hardly ever gain critical mass.

The whole point of ranked-choice voting is to ENCOURAGE
candidates who state their convictions, and to ENCOURAGE
voters to vote for them, by making sure their votes are
NOT WASTED.  If your ideologue is not going to make it
- you can express your support for that candidate (or
proposition) as your first choice, and then express your
second choice if you have one, and your vote is neither
wasted nor effectively converted into a vote for the
candidate you favor least.      The practical effect is
that candidates that have a broad appeal will do better
than candidates that have a narrow ideological appeal.
Yet such candidates would do well to take note of how
many of their votes were second choices, and respond
appropriately.  And that seems to be what the times
require in legislatures: less ideological rigidity,
and a willingness to seek compromise with others who
have different ideologies but are also willing to seek
compromise in order to make progress.

A better way of helping significant minorities, including
ideological ones, to get proportionate representation from
ranked-choice voting is to use multi-member districts.

no more than 20% of voters.     So they get a lot more
attention than those whose votes can be taken for granted.

Rural Bias in American Federalism

American national politics has a rural bias

At the state level the rural bias used to be much stronger,
as many state legislatures imitated the Federal Congress by
having two legislative bodies, with one chosen on a basis
other than population - typically on a per-county basis.
But that was rejected by the US Supreme Court in 1964
on the basis of the Equal Protection Clause of the 14th
Amendment.

Now all legislators in a state must represent approximately
equal numbers of voters or citizens.      This means that
there is much less reason to have two legislative bodies,
but only Nebraska has taken the logical step of instituting
a unicameral legislature -

At the Federal level, despite the 14th Amendment, rural
bias can't be unconstitutional since it is mandated in
the Constitution in a variety of ways -

Art 1, section 3: Each state has two senators, regardless
of population

representative in the House, regardless of population

Art 2, section 1: Each state has electoral votes equal to
the number of senators plus number of representatives

Art 5: constitutional amendments require approval of 3/4
of the states, regardless of the populations represented

12th Amendment: if a presidential election goes to the
House, the vote will be taken by state delegations, so
each state has one vote, regardless of population

And though not in the Constitution, the Senate's practice
of filibuster further magnifies the power of small states.

How does this work out now?  Using data from

* Each senator from Wyoming represents 289,000 people
Each senator from California represents 19,779,000 people,
a factor of 68X

* The representative from Wyoming represents 578,000
people The representative from Montana represents 1,062,000
people, a factor of 1.8X

* Wyoming gets one electoral vote for every 193,000 people
Texas gets one electoral vote for every 755,000 people,
a factor of 3.9X

* Constitutional amendments could be blocked by 13 states
with population 14,325,000, which is 4.6% of the total
of 308,745,000.

* In the House, a President could be elected by 26 states
with a population of 55,510,000, which is 18% of the total
of 308,745,000.

Having small populations makes it cheaper to influence
the votes in small swing states than in large ones.

Is this system democratic?  Democracy is not defined by
majority rule - that's mob rule.    Democracy is defined by
defining and respecting the rights of the minority... and
also the majority.   A system which allows a minority to
indefinitely block the will of the majority, on issues
which do not impinge on the defined rights of the minority,
is not democratic.

What could be done instead, without a constitutional
amendment?

1) The size of the House could be increased from 435 seats
- the NY Times suggests to 593 seats -

Another way of looking at that: increase the size of the
House until the smallest state's one representative is
exactly what it deserves - since Wyoming is the smallest
state, that comes out to about 547 seats.

2) Other states could follow Nebraska and Maine and
allocate their electoral votes according to the results
of their vote rather than accepting winner-take- all.

That might be better for local minority parties and
national majority parties.  Even better would be
to allocate all a state's electoral votes that way -
Nebraska and Maine currently award the two electoral votes
corresponding to the senate to the overall presidential
winner.    But that might increase the chances of elections
being decided by the House -

The founder of the Maine method favors the National
Popular Vote Compact Plan.  If a sufficient number of
states sign onto the compact, they agree to cast all their
votes in favor of the winner of each popular election.
He remembers that a previous attempt to achieve popular
election of the President during the tumultuous 1960's
was defeated by a Strom Thurmond filibuster in the Senate.

The problem with that National Popular Vote Compact Plan
is: what happens if the popular vote margin is 2000 votes?
A national recount might precipitate a constitutional
crisis, particularly if some states decline to recount.

3) Multi-member Congressional districts might reduce the
effects of gerrymandering.

Biden, Sanders, and Trump are too old!

Why bet on a long shot when there are better odds
elsewhere?

How old is too old?  How young is too young?  Commercial
airline pilots have to retire by 60 or 65, depending
on the country.  But big rig drivers have no upper age
limit in the US as long as they can pass their physical.
Presidential candidates don't even have to take a physical,
much less pass one.

Long-term wisdom is important.     But so is short-term
adaptability and vigor.

Presidents need youthful vigor and wisdom of experience,
along with good judgment in picking advisors and
considering their advice.  It's not enough to be adequately
competent now at the beginning of the campaign season.
What are the odds that a successful candidate will still
be on top of the game after eight grueling years?

Figuring presidents usually serve for 8 years, and one
year of service encompasses at least two years of normal
stress, and scripture suggests that the number of a man's
years is three score and ten, or by reason of strength
four score....

one could conclude that a 64 year old candidate would
have aged to 80 by the end of eight years, and that's more
than enough.     So 64 is a good upper limit.

The Constitution puts a  lower limit of 35, but the
president should have lived long enough that his own
fallibility and mortality have become evident to him -
and that suggests 50 - old enough to start thinking about
what kind of legacy to leave.

So a president should be old enough that
viropause/menopause are no longer distant abstractions,
but not old enough to be on medicare.

The nationalization of partisan politics depends on safe
districts for selecting legislators by party primaries
rather than by general elections.    So primaries become
races between ultra and non-plus-ultra even if neither
represent the median interests of the district.   That
primary choke can be addressed by reducing safe districts
by eliminating gerrymandering and voter suppression
and unlimited dark campaign money, and instituting
ranked-choice-voting and multi-member districts.  We'd be
better off without the Senate filibuster, too.

Democrats - don't emulate Republicans!

Republicans have been engaged in a ritual purification,
refining their donor base to billionaire donors and their
voting base to their core Trump supporters -

* racists of various flavors from the Southern Strategy

* evangelicals who believe whatever their leaders tell them

* single-issue voters: guns, abortion, Castro, ...

* "low-information" voters who believe Alex
Jones and Sean Hannity

They've been suggesting that everybody who is not 100%
with the Trump program belongs with the Democrats and other
communists, and the Republicans convinced enough of them
that the Republicans lost the House.

So should the Democrats conduct a similar purge of
everybody who's not radical enough?      That would be
insane.       But it's attractive to some because it's a
lot easier to manage an ideologically uniform party than a
big tent encompassing lots of points of view.     But the
latter has a lot more chance of making things happen.

Obamacare was not the most radical idea in the Democratic
arsenal;  it might have been even less radical than what
Truman proposed in 1945.    But it passed - barely -
and it's probably the best that could have been done at
the time.       Like Social Security and Medicare before
it, the Republicans fought it with every weapon in their
arsenal, and history will repeat itself with Republicans
promising to defend Obamacare soon enough even if they
call it something different.

Likewise coming to terms with global warming is going to
take time - hopefully not too much time, but the human
capacity for denial is enormous.     It's worthwhile to
have aggressive goals but it's also prudent to be willing
to accept that changing attitudes takes time.

Lots of new Democratic House members come from districts
that have been pretty comfortable voting Republican
over the years.      Their disgust with Trump doesn't
translate into support for Bernie Sanders or AOC... now.
Give them some time to get used to new ideas.     It will
take longer if they get scared back to Trumpism.

It's so easy to make the Trump mistake and address an
enthusiastic rally of rabid supporters and think 'the
People are with me!"  Avoid the temptation - the only
certain conclusion is that  "my rabid supporters are
with me" and that's not enough to consistently win
elections and make progress.

Of course, some people would rather win ideological
arguments than elections.  That's admirable to an extent,
but at some point ideological conviction doesn't matter if
it can't get converted into policy by winning elections.

charismatic figure such as Reagan to divert the party’s
focus from the inherent tensions of an ideology-driven
coalition."

A four way election in 2020?

A four-way election with each party getting significant
votes would likely end up in the House, decided by voting
by state delegations.       That would insure a Trump
victory, or at least a Republican one.

We need to do something to avoid an election decided in the
House on a per-state basis by delegations gerrymandered
to over-represent rural Republicans.    But that's a
constitutional amendment decided on a per-state basis
by legislatures gerrymandered to over-represent rural
Republicans.     So we really need to fix gerrymandering
and other voter suppression techniques before we
contemplate any serious reform by constitutional amendment.

What's also certain is that two Democratic candidates
vs one Republican would insure a Republican victory, and
two Republican candidates vs one Democrat would insure a
Democratic victory.

Our two-party system started to go bad with NIxon's
Southern Strategy, leavened by the proliferation of
narrow-cast media liberated from the Fairness Doctrine.
Now the force of the primary election system to choose
candidates has built implicit and explicit racism into
the structure of our politics -

As we have seen in spectacular fashion, the Republicans
promised to the middle and delivered to the base and the
donors.      They need the donors to fund their primary
and general campaigns.     They need the base to win their
primary campaigns.     The persuadable middle voted for

be a mistake for Democrats to think that they own the

How old is too old?

How young is too young?

Presidents need youthful vigor and wisdom of experience,
along with good judgment in picking advisors and
considering their advice.

Figuring presidents usually serve for 8 years, and one
year of service encompasses at least two years of normal
stress, and scripture suggests that the number of a man's
years is three score and ten, or by reason of strength
four score....

one could conclude that a 64 year old candidate would
have aged to 80 by the end of eight years, and that's more
than enough.     So 64 is a good upper limit.

The Constitution puts a  lower limit of 35, but the
president should have lived long enough that his own
fallibility and mortality have become evident to him -
and that suggests 50 - old enough to start thinking about
what kind of legacy to leave.

So a president should be old enough that
viropause/menopause are no longer distant abstractions,
but not old enough to be on medicare.
