What should be done about the Electoral College?

A study of projected electoral college results in 2020
based on 2018 Congressional results indicated a Democratic
victory in the electoral college with 289-324 Democratic
votes and 249-214 Republican votes. The actual vote will
be 306-232, almost identical to the 2016 result, except
in the opposite sense.

That sounds good for Democrats, but a closer look at
the daily variations as the last 2018 votes are counted
and recounted is disturbing - very small variations
in popular votes create very large changes in the
electoral vote. Technically speaking, it's an unstable
algorithm. Clinton would have won in 2016 if the right
40000 votes had switched from Trump to her, 22600 in
Pennsylvania for 20 electoral votes, 5400 in Michigan for
16 electoral votes, 11400 in Wisconsin for 10 electoral
votes. Biden won in 2020 with very similar margins in the
same states and a few others.

The final electoral vote tally 306-232 doesn't reflect
that closeness very well, nor the lopsided popular vote. Is
that really the best we can do?

The Electoral College was intended to protect political
minorities by insuring that presidents have to gain support
across the whole country.

After all, the essence of democracy is observing that
minorities have rights and protecting them; simple majority
rule is the essence of the mob, which the Founders rightly
feared based on ancient and recent precedents.

The winner-take-all outcome prescribed in 48 of the 50
states is a critical part of the method even though
it's not in the Federal Constitution or any Federal
statute. This is the basis for our two-party system
which has mostly provided an uncommon degree of political
stability compared to most other countries. The necessity
of gaining broad national majorities tends to push the
parties toward the center, but this tendency has become
undone in recent years by dark big money in politics and
single-issue narrow-casting media.

Popular election of the president is popular in some
circles, starting with James Madison. But while popular
wisdom generally gets things right eventually, it can
be fooled in the short run. And think about the task
of recounting a very close national popular election,
an enormous labor if we go back to paper ballots, or
an enormous opportunity for fiddling the results if we
don't. Just look at the mischief contesting the 2020
presidential election while carefully NOT contesting the
down-ballot results. This recount task is increased if
ranked-choice voting were adopted, which would otherwise
be a big improvement.

The Missouri Compromise didn't settle a thing.  There was
no way to resolve, by political compromise, the sectional
differences due to 200 years of slavery.  A dynamic
industrializing North, growing in population, could only
be kept in balance with the static feudal slaveholding
South, by empowering Southern minority rule, which became
increasingly tenuous as the relative wealth and population
diverged,      The best that could be done in 1820 and
1850 was to delay the inevitable resolution by other means.

of South Carolina of course - in which he said, in effect,
that the southern colonies would rather remain slaves
to King George than give up their own slaves.     A lot
of this scene is dramatic fiction, but the real Rutledge
apparently worked to have African Americans expelled from
the Continental Army

but Republicans have inherited its feudal mindset of

Why is the tax law so complicated?

You can try to make sense of

but it may be a challenge to keep it all in your head
at once.     Why?

Individual representatives and senators do not generally
have the experience or expertise to draft laws like these.
They are generally tacked on in dead of night to something
big and unrelated - like CARES.     You might well ask,
what do inherited IRA rules have to do with the virus?
The answer, of course, is nothing inherently, but a big
fast-track omnibus relief bill is the perfect place to
hide non-germane goodies.

How does it work?    Lobbyists have draft legislation
ready, and when an opportunity arises, they make the
most of the access they've bought with previous campaign
contributions.  They find a congressman who has the means
to get their bit into the omnibus bill, and remind him
from whom all blessings flow.

They are doing the same thing for the next relief bill,
whenever it comes up for serious consideration.

What can you do about it?     The underlying problem is
unlimited dark money campaign contributions.      But
lobbyists and representatives have built their careers
around the present structure, and will oppose any change.

This of course is the culmination of Mitch McConnell's
career - getting a Federal judiciary in place that
agrees that money in politics is the same as free speech
in politics.     It's one of the underlying reasons that
no matter who you vote for, nothing much changes most of
the time.    You need vast sums to get or defend a seat
in the House or Senate, and that money is easiest to get
from major donors, who are really major investors expecting
return on their investment.

Trump wants to not count illegal immigrants in allocating
House seats

How exactly does he think that can be accomplished?  After
the last four years, it's a safe bet that most illegals
will avoid the census if they can, and will decline to
answer any questions about citizenship if they can.

So presumably he means deducting some estimate of the
illegal population.     Fortunately there's an easy way of
doing that - exclude a percentage of the total population
based on the percentage of Democratic voters in the last
election.

But if we're going to revise how House seats are allocated,
why not make allocation of seats AND APPROPRIATIONS based
on how many votes were cast in the last presidential
election, rather than population.       Unlike census
data, which is always uncertain due to people that don't
want to be counted or even found, vote totals are known
pretty accurately.     And if there were money at stake,
red states will finally be motivated to get eligible
voters registered and to the polls, instead of trying to
keep them away.

Eliminate paid pollution!

Facebook is beginning to see that paid political
advertising right before an election is not a good or
useful thing.

All the thoughtful fact-based analyses went out months
before to people who have an active interest on politics.
All that's left is the last-minute hit pieces designed
to influence people who haven't been following politics,
and so they are heavy on emotional appeal and very light on
facts or logic.   They are sent at the last minute so the
other side doesn't have time to put together an equally
bogus response.

That's why so many people just throw away all the bulk
political paper mail they get right before the election
and tune out the ads on the radio and TV.

So it seems to me like a good idea to prohibit all paid
political advertising in all media for a month before a
Federal election.

Nobody's free speech is impacted - anybody can go down
to the plaza or the mall and speak on behalf of their
candidate.    The impact would be a well-deserved one
on whole parasitic industry for hire - consultants, spin
doctors, dirty tricksters, etc.

At the minimum, all paid political advertising should
always include the name and address of the registered voter
who paid for it and takes responsibility for its accuracy.

Direct election of presidents by popular vote seems
hazardous for a different kind of reason - aside from
issues of counting late mail-in ballots - what if the final
tally shows one candidates winning by 1000 votes (roughly
the final winning margin of Bush in Florida in 2000)?
Naturally there will be demands for a recount - but what
if a secretary of state refuses to authorize a recount in
that state?      Who's going to make him?

There are a lot of things that could be done differently,
but if it's going to be decided indirectly, let it be
by the newly-elected House that presumably reflects the

members, not state delegations!
